DALLAS – A Texas Fifth District Court of Appeals panel on June 8 affirmed summary judgment for the defendants in a workplace accident action, concluding that the plaintiff failed to show that the defendants had a duty to ensure he was wearing fall-protection equipment while working as a roofer (Alberto Hernandez v. Hammond Homes Ltd., No. 05-09-01382-CV, Texas App., 5th Dist.; 2011 Tex. App. LEXIS 4334).
