What is the Exactech Recalls Lawsuit?
As someone living in Atlanta who either needed joint replacements or have a loved one with a joint replacement, you may have heard about the recent recall of knee, hip, and ankle replacement products due to defects. These replacements were commonly known to replace arthritic joints due to osteoarthritis, rheumatoid arthritis, and other painful joint issues.
According to the U.S. Food and Drug Administration, Exactech issued a recall for joint replacement devices manufactured between 2004 and August 2021 and recalled in 2021 and 2022. The recall was issued due to a defect in the manufacturing process of the knee, hip, and ankle replacement products. More specifically, the defective bags were missing oxygen barriers that protect them from oxidation. In other words, defective products are more likely to wear down the products; resulting in a need for corrective revision surgery. However, many doctors and insurance companies are not covering the costs of corrective surgeries.
Exactech has issued a recall that impacts more than 140,000 Opetetrak, Optetrak Logic, and Truliant knee replacement systems, 130,000 hip replacement systems, and 1,500 ankle replacement systems. There have been more than 775 Exactech recalls lawsuits nationwide, and the number only continues to grow. If you or a loved one have received a knee, hip, or ankle replacement product in the past few years, you may be impacted by the recall. It’s important to check to see if you received one of the recalled products.
What do I do if I have a potentially defective implant?
Defective implants can be uncomfortable and dangerous. If you or a loved one has received a potentially defective implant, you may check to see if your device is part of their recall on their database. If you experience any of these symptoms:
-
- new or worsening pain,
-
- more bone loss,
-
- swelling in the affected area
and your device is listed, you may right to compensation. In most states, individuals have legal claims and the right to compensation for injuries they suffer as a result of a medical product defect. Patients may claim compensation for pain and suffering, medical expenses (such as corrective surgery), lost past and future wages, and punitive damages.
